When a beta version of iOS "expires" you no longer have access to the operating system on the phone. So, no you can't get to settings you can get to anything so you cannot just turn off find my iPhone.
Erase data is one of the options that you have under the find my iPhone app. If a phone is lost it's one of the things you can do to protect your data. It is not part of the normal restore/upgrade process.
In follow-up to my original post the race data does not affect the Sam. I was able after using that function to restore an upgrade the phone to the next beta version. Then restore from a recent back up the phone is now back to normal.
