If you want to go after someone, because the new iPhones are not waterproof, then go after CNET and Jessica Dolcourt, the writer.
Apple only claims water resistance, not water proof. It even suggest not to swim with it. So another "storm in a tea cup", about nothing.
If you were to buy a dive watch, it would not be water proof, but only water resistant to a defined depth. The iPhone is only resistant to the lowest classification, splash resistant. Read your warranty.
