All brands of cell phones will bend if you sit on them. Read a couple of articles and you will find at least one other brand mentioned. Moral, don't sit on your cell phone. It is just like the claim that every OS upgrade there are claims that it has worse battery life... until someone explains to the newbie to check and adjust their settings.
As to scratches, he may feel he didn't cause the scratches, but if they happened after he opened the box, then it could not be Apple's fault.
We always hear about the problems or whines of the few and seldom hear from the majority that have acceptable or good experiences.
If you are still uncertain, then wait a bit. I usually wait, and try to pick up a case the same day I buy a new phone, because I do on occasion drop the phone or put it in my pocket. I just never sit on it.
