I agree with you, but how would he "prove" that he was streaming from Netflix?
I would ask them how they know he was using tethering. They can't. Then tell them that he was streaming video. Then volunteer to show them that he has no tethering app on his iPhone. Then ask for an apology in writing as a means to document their accusation and error.
BTW, AT&T raised the price of the tiered plan has gone up, so there is no advantage to switch to a tiered plan unless you drop to a less than 3 Gb plan.
