The penalty is not having 12 months complete on your contract... so you have to pay "full price" not the subsidized price if you want a new phone.

Yeah, and if I recall [correctly] the last time they went under the 12 month cycle, Apple asked AT&T, who was the only carrier then, to go ahead and give previous iPhone owners the subsidized price.

I guess I'd be called an "Apple fan-boy", as I have had each iteration of iPhone since the first iPhone came out (as well as having Mac's since 1984). It was great when they'd announce iPhone's in June. My wife always gave me that for my birthday!
