You didn't make didn't make it clear that you were going to keep 2 iPhones or even 2 cell phones. That was my confusion.
As far as I have seen, with AT&T you can not have a iPhone without a data plan for it. They can detect the type of phone using the SIM card and will add a data plan if you try to trick them, by say buying a dumb phone on a contract.
I would look into a family plan or switching the iPhone you don't want to another carrier that might allow it without a data plan, which by the way I don't know if you can find one. But, oh yeah, since your contract on the iPhone 4 is not satisfied, they won't unlock it.
Your best bet right now is either put the iPhone 4 in a drawer or see if they have started allowing family plans with shared data.
Aren't you glad all the US cell providers subsidize the cell phones. Even if you pay full price for the phone, you don't get a break on the service prices.

if you are not adding an extra phone, buy another iPhone, new or ebay, and if you move to a new model, ask AT&T for an new SIM card if you need to change sizes. No need to pay an extra $10 a month & no broken contact.
