I hate to sound stupid but dont I still have to pay 10 bucks. Sorry for confusion. I want to buy a 4s and replace my 4 but I'm not eligable for upgrade

if you are not adding an extra phone, buy another iPhone, new or ebay, and if you move to a new model, ask AT&T for an new SIM card if you need to change sizes. No need to pay an extra $10 a month & no broken contact.
